Terms & Conditions.

The agreement between you and me when you engage my services.

Terms & Conditions of Jitse Walravens (hereinafter "I", "me" or "the freelancer")

1. Who These Terms Apply To

These terms and conditions apply to all quotes, offers, agreements and services provided by Jitse Walravens, freelance graphic designer and web developer, registered in Belgium under enterprise number BE0767.706.795 ("the client" refers to any person or company engaging these services).

By accepting a quote, signing an agreement, or otherwise commissioning work, you agree to these terms.

2. Quotes & Pricing

I don't work with a fixed hourly rate. Every quote is therefore an indicative estimate, based on the information provided by the client at the time of the request. The final price may vary slightly depending on the actual complexity, scope, or changes to the project once work has started - any such changes will always be discussed and agreed with you first.

Quotes are valid for the period stated on the quote document (typically 30 days) unless otherwise agreed. As a VAT-exempt freelancer (under the Belgian small business scheme), no VAT is added to quotes or invoices.

3. Payment

Payment terms are agreed per project and may include a deposit before work begins, one or more milestone payments during the project, and/or a final payment upon delivery - the exact split will be confirmed with you before work starts.

Invoices are payable within 14 days of the invoice date, unless a different term is agreed in writing. Final files, source code, or deliverables are only handed over once full payment has been received.

4. The Process & Your Involvement

Projects typically follow four steps: discovery, quote & planning, design & build, and launch & handover. Your timely feedback at each stage helps keep the project on schedule - delays in feedback or providing necessary materials (text, images, logins, etc.) may extend the delivery timeline accordingly.

5. Revisions

Feedback rounds and revisions are included as part of the agreed price - I want you to be genuinely happy with the result, not just technically done. That said, revisions should stay within the original scope of the project; requests that significantly change or expand the original brief (additional pages, new features, a different design direction) may be treated as additional work and quoted separately.

6. Intellectual Property & Ownership

Upon full payment, ownership and usage rights to the final delivered work (e.g. website, logo, design files) transfer to the client, for the purpose they were created for.

I retain the right to display the completed work in my portfolio, on my website, and on social media as an example of my work, unless we've explicitly agreed otherwise in writing (for example for confidential or competitively sensitive projects).

Until full payment is received, all intellectual property remains with me. Reusable code components, frameworks, or tools I've developed independently of a specific project remain my property and may be used in other work.

7. Third-Party Costs

Costs for third-party services such as hosting, domain registration, stock photography, fonts, or plugins are not included in my service fee unless explicitly stated in the quote, and are billed separately by the relevant provider or passed through at cost.

8. Cancellation

Either party may cancel an ongoing project in writing. In that case, you'll be invoiced for the work completed and hours/costs incurred up to the cancellation date. Any deposit already paid will be offset against this amount; the remainder (if any) will be refunded or invoiced accordingly.

9. Liability

I make every effort to deliver high-quality, functional work, but I cannot guarantee that a website or application will be entirely free of bugs or errors. I am not liable for indirect damage, loss of revenue, or loss of data resulting from the use of delivered work, except in cases of intent or gross negligence on my part.

If a bug or error is found in the delivered work that was already present at the time of delivery, I will fix it free of charge within a reasonable period after you report it. This does not cover issues caused by changes made by you or third parties after delivery, or by browser, plugin, or third-party service updates outside my control.

For hosting specifically: I partner with Hostinger and assist with setup and support, but I am not liable for outages, data loss, or issues caused by the hosting provider itself - these fall under Hostinger's own terms of service.

10. Confidentiality

Any confidential information you share with me in the context of a project (business information, credentials, unpublished materials) will be treated as confidential and not shared with third parties without your permission.

11. Applicable Law & Disputes

These terms are governed by Belgian law. In the event of a dispute that cannot be resolved through direct discussion, the courts of the judicial district where I am registered will have jurisdiction.

12. Changes to These Terms

I may update these terms from time to time. The date at the top of this page shows when it was last updated. Changes do not apply retroactively to ongoing projects already governed by a previously agreed quote, unless we agree otherwise.
